General Terms and Conditions of Sale (hereinafter referred to as “T&Cs”)

These General Terms and Conditions of Sale establish a legal agreement and apply to all bookings of services and product orders concluded between the Client and the photographers Laura Witvrouw and Donatienne Dupont, hereinafter referred to as “the photographers.”

Any booking of a session or product order implies full acceptance of these T&Cs by the Client, unless otherwise agreed in writing between the photographers and the Client.

1 – Prices

All prices are expressed in euros, tax-free (VAT not applicable, article 293B of the French Tax Code) and are those applicable at the time of booking or product order.

Prices may be modified at any time without notice. The valid price is the one indicated on your signed contract and/or order form.

2 – Booking and Payment

A session may be booked:

  • By email at contact@lauradonatiennephoto.com

  • Via the contact form on the website

  • By private message on our official social media (Instagram / Facebook)

A first deposit of 30% is due upon signing the contract, a second deposit of 30% no later than 3 months before the wedding, and the balance (40%) no later than 1 month before the wedding date.

No photos will be delivered until full payment has been received.

Payment of a deposit constitutes a firm commitment by the Client and implies full acceptance of these T&Cs.

If payment is not received within 5 days of the photographers confirming the date and time, the booking will be cancelled without notice or compensation.

Payments may be made by bank transfer, cheque, or cash.

No discount will be granted for upfront payment.

In accordance with the law, the Client has a 7-business-day withdrawal period from the day after the booking. After this period, all amounts paid are considered non-refundable.

In case of a returned cheque, the Client will have 72 hours to regularize payment by transfer. Any delay will result in the application of statutory late payment interest (article L441-10 of the French Commercial Code) as well as a fixed €40 recovery fee.

3 – Gift Vouchers

Gift vouchers must be paid in full at the time of order and are valid until the date indicated on the voucher.

After this date, the voucher is neither refundable nor transferable.

The recipient must book at least two (2) months before the expiry date.

4 – Session Procedure

The Client agrees to respect the agreed time schedule.

If the Client is more than 30 minutes late, the session may be cancelled without refund.

The Client must fully cooperate to ensure the best possible outcome of the photographs.

The photographers cannot be held responsible for lower-quality images due to lack of cooperation.

5 – Technical Issues

In the event of equipment failure, technical incident, or data loss preventing delivery of the photographs, the photographers will either propose a new session or a full refund of the amounts paid.

No additional compensation may be claimed.

6 – Photographic Style

The Clients acknowledge that they are familiar with the photographers’ artistic style and engage their services knowingly.

No raw files (RAW) will be delivered.

Images are delivered in high-quality JPEG format.

Photos are stored for one year, unless a major technical incident occurs beyond the photographers’ control.

Editing includes color correction, exposure adjustments, and minor corrections (temporary imperfections).

Any morphological retouching or major modifications will be refused.

Delivery time is approximately 2 to 3 weeks. In case of exceptional delay, the photographers will inform the Clients; no compensation may be claimed.

7 – Force Majeure and Illness

In the event of force majeure or illness, the photographers reserve the right to reschedule the service without any claim for damages.

A new date will be agreed upon by both parties.

Any date change requested by the Client must be made at least 7 days before the session.

In case of Client cancellation, the deposit remains acquired by the photographers.

8 – Intellectual Property

In accordance with the French Intellectual Property Code, the photographers retain copyright over all images created.

The delivered photographs may only be used within a strictly private and family context.

Any commercial publication, reproduction, modification, cropping, or transfer to third parties is strictly prohibited without prior written authorization.

9 – Image Rights and Publication

The photographers require written authorization from the Client for any use of images for communication purposes (website, social media, brochures, etc.).

The Client is free to refuse such publication.

If a session was offered or discounted in exchange for publication rights, a subsequent refusal will result in billing of the session at the standard rate +50%.

10 – Liability

The Client is responsible for themselves and any minors present during the session.

In the event of damage to equipment, the Client must reimburse its replacement at new value.

The photographers hold professional civil liability insurance.

11 – Complaints and Disputes

Any complaint must be submitted by registered mail with acknowledgment of receipt within 5 days following the service.

In case of dispute, the parties will attempt to find an amicable solution.

Failing that, the competent court will be the Tribunal de Grande Instance of Niort.

12 – Data Protection (GDPR)

In accordance with the General Data Protection Regulation (EU 2016/679), personal data collected (name, contact details, photographs) is only used for managing services and fulfilling legal obligations (invoicing, order-related communication).

Data is never sold or transferred.

Clients have the right to access, rectify, and delete their data by sending a request to:

Invoices are kept for 10 years in compliance with accounting obligations.

13 – Amendments to the T&Cs

The photographers reserve the right to amend these T&Cs at any time.

The new conditions take immediate effect, including for services already booked, unless otherwise agreed in writing.

The Client acknowledges having read and accepted these General Terms and Conditions of Sale without reservation.
